Morocco: towards a legal framework for street vendors

The Economic, Social and Environmental Council recommended creating an appropriate legal framework for Moroccan street vendors, in order to allow them to make a gradual and smooth transition to the formal sector.

According to the Council, “one of the conditions for the transition of street vendors to the organized sector and the conditions for the release of energies for an active and productive economy is the existence of an integrated legal environment which governs the activities of the trade. wandering ”.

To this end, the council indicates that “it is urgent that the national legislative system complete its arsenal by approving the legal status of street vendors of all categories, stipulating the conditions and obligations imposed by the practice of street commerce, defining and simplifying the procedures, clarifying the powers concerning the use of public space and approving the sanctions in the event of violation of the law ”.

Likewise, it is necessary to update, simplify and make transparent the regulatory requirements and the authorization procedures for temporary occupation of the public domain by street vendors, whether through the operation of permanent locations in an environment. urban or semi-urban or rural communities, either using vehicles or operating sites on highways, the document added.

In addition, the EESC proposed to the governors to “support the reform and reintegration process, by providing in criminal legislation for the possibility of following a vocational training program as an alternative to custodial sentences for people convicted of certain crimes who suffer fragility, and to reduce the length of the custodial sentence for the benefit of certain categories of detainees when they are the subject of a professional training program ”.
